Welcome to Xturi! These Terms of Service (“Terms”) govern your access to and use of the Xturi website, https://xturi.com (“Site”), and any services provided by Xturi (“we,” “our,” or “us”). By accessing or using our Site, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Site.

1. Acceptance of Terms

By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you are using the Site on behalf of an organization, you represent that you have the authority to bind the organization to these Terms.

2. Description of Services

Xturi is an online marketplace where providers can upload their experiences and consumers can book those experiences. Xturi charges a commission on each booking, which ranges from 2% to 7%.

3. Eligibility

You must be at least 18 years old to use our Site. By using the Site, you represent and warrant that you meet this eligibility requirement.

4. Account Registration

To use certain features of the Site, you must create an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Notify us immediately of any unauthorized use of your account.

5. User Responsibilities

As a user of the Site, you agree to:

  • Use the Site in compliance with all applicable laws and regulations.
  • Not engage in any activity that interferes with or disrupts the Site.
  • Not upload, post, or transmit any content that is illegal, harmful, or offensive.

6. Provider Responsibilities

If you are a provider uploading experiences, you agree to:

  • Honor all bookings made through the Site.
  • Not engage in any deceptive or misleading practices.

7. Booking and Payment

Consumers can book experiences through the Site. By booking an experience, you agree to the terms and conditions set by the provider. Xturi charges a commission on each booking, ranging from 2% to 7%. Payment processing services are provided by third-party payment processors, and you agree to their terms and conditions.

8. Cancellations and Refunds

Cancellation and refund policies are determined by the providers. Consumers should review the provider’s cancellation and refund policy before booking. Xturi is not responsible for any cancellations or refunds.

9. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is the property of Xturi or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from the Site without our prior written permission.

10. Content Usage License

By uploading content (including but not limited to images, videos, descriptions, and other media) to their experience listings on the Xturi platform, providers grant Xturi a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, and distribute such content for any purpose, including promotional and marketing efforts. Providers affirm that they have the necessary rights and permissions for all content submitted and that such content does not infringe on any intellectual property rights of third parties.

11. Disclaimers

The Site and services are provided “as is” and “as available” without warranties of any kind, either express or implied. Xturi disclaims all warranties, including but not limited to the accuracy, completeness, and reliability of the Site and services.

12. Limitation of Liability

To the maximum extent permitted by law, Xturi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Site.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the Site.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party.
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Site.

13. Indemnification

You agree to indemnify and hold harmless Xturi, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Site. You are advised to review these Terms periodically for any changes. Your continued use of the Site after the posting of changes constitutes your acceptance of such changes.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts of Costa Rica.
